Articles of Association on Debit Card of Industrial and Commercial Bank of China Vientiane Branch

Article 1 In order to provide better services to cardholders and regulate the issuance and use of our bank's debit card, the articles of association are formulated.

Article 2 The debit card mentioned in the articles of association refers to the credit card issued by the Industrial and Commercial Bank of China Vientiane Branch (hereinafter referred to as the issuing bank) to individual customers, which can be used after deposit and is equipped with all or part of the functions including consumption settlement, transfer and remittance, cash deposit and withdrawal and investment and financial management.

Article 3 Debit cards are classified into magnetic stripe cards, pure chip cards and composite magnetic stripe chip cards by the type of media (hereinafter, pure chip cards and composite magnetic stripe chip cards are collectively referred to as chip cards). Cardholders can use chip cards to conduct transactions on devices with corresponding functions.

Article 4 Any individual who voluntarily abides by the articles of association and meets the card issuance conditions can apply for a debit card from the issuing bank with his/her valid ID. To apply for a debit card, he/she must fill out an application form to confirm compliance with the Articles of Association of Debit Card of Industrial and Commercial Bank of China Vientiane Branch.
Cardholders who use debit cards to conduct business shall abide by the relevant regulations of the issuing bank.

Article 5 Cardholders can conduct transactions with their cards and passwords at ICBC Vientiane Branch business offices, designated merchants, and ATMs, self-service terminals and self-transfer terminals with all or part of the functions of deposit and withdrawal, transfer, remittance, inquiry, payment, investment and wealth management, etc. It can be used on personal transfer terminals and other equipment (hereinafter collectively referred to as self-service equipment), and also at acceptance points such as domestic and overseas ATMs and special merchants of relevant bank card organizations.
Cardholders can apply for electronic banking services including online banking and mobile banking with their card and password. Cardholders must also comply with the relevant regulations of the issuing bank regarding electronic banking services when handling electronic banking services.
Cardholders can apply to close or activate transaction functions such as consumption, cash withdrawal or transfer of debit cards in self-service equipment and special merchants channels based on their transaction habits.
To apply for a debit card, a password must be set. Cardholders who use a debit card for transactions including consumption settlement, withdrawal, transfer and remittance must be based on password (chip card electronic cash transactions excluded). All transactions conducted by using passwords will be regarded by the issuing bank as the conducts by cardholder himself/herself. The electronic information records generated by various transactions based on passwords and other electronic information are all valid evidence of the transaction. Cardholders must properly keep the debit card and password. The issuing bank shall not be liable for losses caused by improper custody of the cardholder. Debit cards can only be used by cardholders approved by the issuing bank. Cardholders who entrust others to handle business on their behalf must comply with the relevant business agency regulations of the issuing bank.

Article 6 Cardholders who lose their debit card shall go through the loss reporting procedures in time. Loss reporting is divided into temporary loss reporting and formal loss reporting. Cardholders can handle temporary loss reports at business offices or through e-banking, telephone banking and other channels. When reporting the loss, they need to provide card number, account name, ID card number, balance, residential address, card issuance date and other information for verification by the issuing bank. Within 15 natural days (counting from the day of loss reporting) of the temporary loss reporting, formal loss reporting procedures must be completed, otherwise the temporary loss reporting will automatically become invalid.
A formal loss report is a written loss report. The cardholder needs to hold his/her valid ID documents for opening the account, and provide information including card number, account name, ID card number, balance, residential address, card issuance date and other information, and go to the business office of the issuing bank to handle it. After the cardholder has formally reported the loss, he/she can go through the procedures of reissuing a new card or canceling the card after the specified time limit.
If the cardholder cancels the loss report, the cardholder must present his/her valid ID documents, the debit card that has been reported as lost, and the retention copy of the loss report application form to apply to the business office for the cancellation of the loss report.
Once the loss report procedure is completed, the loss report will take effect. The bank shall not be liable for all economic losses incurred by the cardholder due to the loss of the debit card before the loss report becomes effective or after the loss report becomes invalid.

Article 7 If the cardholder enters the wrong password more than 6 times consecutively, the issuing bank will lock the debit card account. If the cardholder still remembers the password, he/she needs to go to the business office of the issuing bank to unlock the account with his/her valid ID documents and debit card, and unlock the account after the issuing bank verifies that the password is correct.
If the cardholder forgets the password, the cardholder should present his/her valid ID and debit card to apply in writing to the card-issuing bank's business office for password reset procedures.
Article 8 Cardholders can handle domestic and foreign currency current and time deposits with debit cards. Debit card does not have overdraft function.

Article 9 When the cardholder uses the card to handle business on the self-service equipment, if the card is swallowed due to machine failure or operational error, he/she can present his/her valid ID documents and other materials that can prove that he/she is the cardholder within 3 working days after the card is swallowed (counting from the day after the card is swallowed) and go to the bank that the self-service equipment affiliated to for the card collection procedures. In case of overdue card claim, the bank in possession of the ATM has the right to deal with it in accordance with the prescribed procedures.

Article 10 The chip card has an expiry date. In case of the function upgrade of debit card, damages to card or expiration of card, the cardholder shall go to the banking office of the issuing bank while presenting his/her valid ID card and debit card, to change the card with the password.

Article 11 The issuing bank provides the cardholder with reconciliation services such as account inquiry through E-bank, ATM or banking office. The issuing bank shall give a reply within 30 workdays to the cardholder on account inquiry and request for correction.

Article 12 The issuing bank shall formulate charging items and standards for debit card services in accordance with the relevant laws, regulations, and regulatory provisions of Laos. The information about charging items and standards are available at banking offices, on the website (www.icbc.com.la) or through other channels. The cardholder shall pay the relevant fees according to the charging items and standards, and the payment methods stipulated by the issuing bank. In case of any modification to the charging items and standards of debit card, the latest announcement made by the issuing bank shall prevail.

Article 13 The cardholder has the right to terminate the debit card at any time. The issuing bank has the right to stop the cardholder from using the debit card in accordance with the relevant laws and regulations, provisions specified in these articles, and the relevant agreements.
If a cardholder needs to terminate his/her debit card, he/she shall present his/her valid ID card and debit card, and submit a written application for card cancellation to a banking office of the issuing bank. The cardholder can handle the card cancellation procedures upon the acceptance by the banking office. If the cardholder violates the relevant laws, regulations, and rules of Laos, or the provisions specified in these articles, or if the cardholder fails to pay the relevant fees as required by the issuing bank, the issuing bank has the right to stop providing the relevant services to the cardholder at any time. In case of termination of the debit card due to other reasons, the issuing bank shall notify the cardholder in advance by issuing a notice at its baking offices or on the website (www.icbc.com.la). If the cardholder is hindered from using the card due to power supply, communication, and system failure, etc., the issuing bank should assist the cardholder in solving the problem or provide necessary assistance, as the case may be, but shall not be liable for any loss that may be caused to the cardholder.

Article 14 The issuing bank shall keep the cardholder's information confidential according to law, and shall not disclose it to any entity or individual without the consent of the cardholder, except as otherwise provided by laws, regulations and rules, or as otherwise agreed by the cardholder and the issuing bank.

Article 15 The articles of association shall be formulated, amended and interpreted by the issuing bank. If the issuing bank modifies the articles, the modified articles shall be published at its banking offices or on the website. The amended articles shall come into force after 30 days of announcement. The cardholder has the option to stop using his/her card during the announcement period. If the cardholder decides not to continue using the card due to objection to the amended articles, he/she may apply to a banking office of the issuing bank for cancellation of his/her card. If the cardholder fails to apply for card cancellation upon the expiration of the notice, it shall be deemed that he/she agrees to continue using the card. Notices issued by the issuing bank in a lawful manner (including, but not limited to, notices issued at its baking offices or on the website) that are valid for the duration of the card (including those issued before and after the issuance of the card) are also applicable to the cardholder. In case of any inconsistency between the notice and the articles of association, the one issued later shall prevail
